Legal Notice

Viollier AG, with its head office in Basle (Switzerland), operates the websites www.viollier.ch, www.viomecum.ch and http://eshop.viollier.ch (referred to below as "WEBSITES"). Viollier AG provides information on laboratory medicine alongside other information and other content and items on the WEBSITES (referred to below as "CONTENT"). It is also possible to request products and services relating to laboratory medicine (referred to below as "PRODUCTS") from Viollier AG via the WEBSITES. Any person accessing the WEBSITES, searching the CONTENT and/or requesting PRODUCTS (referred to below as the "USER"), hereby acknowledges acceptance of the following conditions.

Scope of Validity

The WEBSITES are intended solely for persons who have offices or are resident in Switzerland, the Principality of Liechtenstein, Germany, Austria, France, Belgium, Luxembourg or Italy. Persons from other countries are not entitled to access the WEBSITES.

The CONTENT and PRODUCTS on the WEBSITES are primarily intended for doctors and other professional medical staff (e.g. in hospitals). All other USERS are specifically alerted to the fact that access to the WEBSITES and the CONTENT provided on the WEBSITES should not, under any circumstances, take the place of a consultation with a professional doctor or obviate the need for a medical appointment and that the CONTENT and PRODUCTS are not intended to self-use or self-medication.

Access to and availability of the WEBSITES

Access to the WEBSITES is at the USER's own risk. In particular, Viollier AG shall not offer any guarantees in respect of access to the WEBSITES, availability to the WEBSITES at all times or smooth operation of the WEBSITES. Viollier AG cannot guarantee that the WEBSITES or the respective servers are free of viruses or any other harmful content. Viollier AG declines to accept liability for any ensuing damage to the USER or third parties.

Viollier AG expressly reserves the right to block or restrict access to the WEBSITES at any time and without prior notice or to modify the CONTENT of the WEBSITES.

Intellectual Property

All CONTENT on the WEBSITES is protected by copyright and trademark and is the exclusive property of Viollier AG. This does not apply to the copyright and trademark rights of third parties.

The USER may only use the CONTENT of the WEBSITES, either in part or in full, for his own purposes. The USER's authority to use the WEBSITES only extends to printing out and downloading the CONTENT of the WEBSITES. Copyright information, trademarks and other names which are protected by law may not be amended or removed by the USER. Any further use of the CONTENT of the WEBSITE, i.e. copying, transmitting, uploading or making available in a closed or open network or processing and use for the purpose of third parties or for public or commercial purposes, is not permitted without the prior written approval of Viollier AG. All data and information passed on to Viollier AG by the USER and any ideas, concepts, techniques or knowhow contained therein may be used free of charge by Viollier AG for any purposes whatsoever and transmitted to third parties. The data protection regulations shall still apply.

Links to the WEBSITES must refer to the respective home page. Deep linking or framing in WEBSITES or other techniques in which the WEBSITES or parts thereof are incorporated in the WEBSITES of USERS or third parties in some form, are not permitted without the prior approval of Viollier AG.

CONTENT of WEBSITES

Viollier AG shall check the CONTENT provided on the WEBSITES on a regular basis to ensure that it is accurate and up-to-date. However, Viollier AG cannot offer any assurance and shall not assume any guarantee or liability that the CONTENT of the WEBSITES will be complete, correct and up-to-date at any given point in time. The CONTENT of the WEBSITES may also contain technical inaccuracies or typing and translating errors. Viollier AG expressly reserves the right to modify, supplement or delete the CONTENT at any time and without prior notice.

Further use of the CONTENT and PRODUCTS of the WEBSITES is the exclusive responsibility of the USER. Viollier AG declines any liability for any ensuing damage to the USER or to third parties.

The CONTENT and PRODUCTS available on the WEBSITES do not constitute a binding offer on the part of Viollier AG to the USERS. Viollier AG expressly reserves the right to decline inquiries or offers from USERS without proffering any reason for its decision.

WEBSITE Finance and Advertising

The WEBSITES are financed fully and exclusively by Viollier AG. Advertising is not permitted or desired in any form.

Data Protection and Data Security

Viollier AG shall save personal data relating to USERS. Viollier AG shall only use personal data relating to USERS for the purpose for which the USER supplied Viollier AG with this information. Viollier AG shall not pass personal data to third parties (with the exception of companies associated with Viollier AG) without the USER's approval.

The USER shall hereby grant approval for Viollier AG (including any companies associated with Viollier AG) to use his personal data for internal marketing purposes and to keep the USER regularly informed about CONTENT and PRODUCTS supplied by Viollier AG. The USER shall note that transmission of data from or to the WEBSITES is at his own risk. Data is not encoded and is transmitted via an open network. The USER shall note that data may be lost or may be picked up and/or manipulated by unauthorised persons during this process. The USER is expressly advised not to send his own personal health-related data or that of third parties to Viollier AG. Viollier AG declines any liability for any ensuing damage to the USER or third parties.

Linked Websites

The WEBSITES contain links to other websites. Viollier AG has not checked these websites and accepts no responsibility or liability for the content of these websites or the products offered on these websites. Activating a link is always at the USER's own risk. Links to the WEBSITES which are set up by third parties are outside the control and influence of Viollier AG. Viollier AG shall not accept responsibility for the content of websites, or the products, services or other items offered on websites which refer to the Viollier AG WEBSITES.

Modification Right Reserved

Viollier AG expressly reserves the right to modify this legal information at any time without prior notice. The USER must ensure that he has the relevant correct information before proceeding.

Place of Jurisdiction and Applicable Law

The sole place of jurisdiction for all legal relations arising from access to the WEBSITES by USERS shall be at Viollier AG's head office in Basle (Switzerland). Substantive Swiss law shall apply exclusively to such legal relations.
